Terms of Delivery and Payment to Customers
These are the terms and conditions of trade with Heeken House Ltd., Registered Office: 17 Old Courts Road, Brigg, DN20 8JD
For all deliveries, only the following terms of delivery and payment of Heeken House Ltd. are valid:
Requested changes by the customer require written approval. Heeken House Ltd. reserves the right to vary both the technical details and the shape and colour of their products. Where given, weights, sizes, capacity performance and colours etc are for guidance only.
Prices
Unless otherwise described, all prices are quoted net, ex warehouse and are subject to alteration without notice. With the publication of a new price list all previous price lists lose their validity. Packaging costs are included in the prices so far as no special packaging has been requested by the customer.
Payment
Payment will be due within 7 days of order. Non payment will result in order being cancelled.
On bulk orders payment conditions will be those set out in the order confirmation.
Failure to pay within 30 days of date of invoice, entitles Heeken House Ltd. to charge a penalty interest of 10% per annum beginning from the due payment date. Foreign payments must arrive free of any charges. Customer credit is wholly at Heeken House’s discretion.
Discount
A discount is negotiable on bulk purchases.
Delivery
Charges: Freight charges will be billed at cost unless otherwise agreed.
Goods will be packaged as described in the product description. Any article out of stock will be cancelled and should be re-ordered with your next order. Industrial action, fire, war, natural catastrophes, hijacking, acts of God and other unusual uncontrollable events, relieves Heeken House Ltd. from the sales contract and duty to fulfil it, for the duration of those events. Any claims for damages, due to negligence on the part of Heeken House Ltd., will be limited to the purchase price. Costs arising due to obstacles to delivery created by the customer, are the customers responsibility. Delivery always takes place at the buyer's risk and expense unless otherwise stated. This risk comes into force when the goods leave the hands of Heeken House Ltd. into those of the freight forwarder (post, rail, shipping agent, courier etc.).
‘Cooling Off’ Period
We allow consumers who have bought our product 14 days to change their minds if the product is not suitable. The product must be returned in its original packaging unused, at the consumers expense. Only the product cost will be reimbursed.
Guarantee
Obvious defects to products must be notified within 8 days of delivery. Non obvious defects must be notified within 8 days of discovery but at the latest within 6 months of delivery. In the case of a justified claim within the time limits, Heeken House Ltd. will choose, either to deliver a replacement free of charge, or to correct the defects. An adequate period of time to carry out these measures must be allowed. Should the replacement or correction be similarly damaged, the customer is entitled to claim a reduction in price or to cancel the order. Further claims are not allowed unless wilful or gross negligence can be shown.
Under no circumstances should goods be returned without prior written approval - goods returned without approval will be turned away!
Ownership
Goods delivered remain the property of Heeken House Ltd. until full payment of all outstanding debts is fulfilled, including those arising out of future transactions, has been received - even if payment on certain named goods takes place. Goods belonging to Heeken House Ltd. are only to be sold in normal business transactions if payment of the debt to Heeken House Ltd. is ensured through this resale and their title to these goods is forwarded to the buyer. At this point the debts to Heeken House Ltd. are due. The authorisation to resell can be revoked at any time. Goods still the property of Heeken House Ltd. are not to be mixed with other goods or to be worked on.
